EEAS responds to written enquiry on Ablyazov
The European External Action Service has responded to the written enquiry from an MEP on the Kazakh dissident, Mukhtar Ablyazov.
The Commission expressed its regret and stated that it lacked sufficient competence to intervene in Ablyazov's case. His case goes beyond EU law - his extradition is a matter of a bilateral agreement between an EU member state and a third state. The Charter of Fundamental Rights, according to its article 51, is applied solely to the extent to which member states apply the EU law, said High Representative C. Ashton. When a given state does not apply the EU law, its authorities should guarantee that fundamental human rights are respected based on existing international memorandums and domestic legislation.
In its response, the EEAS states that France should comply with the European Human Rights Convention, protecting individuals from extradition when there is risk of torture being used, at the same time securing their right to a free trial.
In conclusion, the Commission promised to continue to monitor the human rights situation in Kazakhstan.
