Statement by defence lawyers representing Mukhtar Ablyazov following the decision by the Court of Cassation overturning both extradition rulings
Mukhtar Ablyazov’s defence team is celebrating the decisions delivered on 9 April 2014 by the Cassation Court – the highest French national court – which overturned the decisions rendered by the judges in Aix-en-Provence, decisions that were rendered in particularly obscure circumstances and in violation of the fundamental principles of law. The Aix-en-Provence court ruled in favour of Russia and Ukraine on their requests for the extradition of Mr. Ablyazov to Ukraine and to Russia. Maître Jean-Pierre Mignard "congratulates this wise decision, taking into account also the worrying elements concerning the opinion of the instruction chamber of the Court of Appeal of Aix-en-Provence".
It is now up to the Court of Appeal of Lyon to render a judgment regarding the extradition requests made by Russia and Ukraine, who are acting, according to Maître Bruno Rebstock as "a cover for Kazakhstan”.
Ukraine’s request shall be re-examined in the light of significant events that have shaken the State in its move towards democracy. Russia’s request, strong decisions having been taken, Mukhtar Ablyazov’s defence team wants to be able to trust once again, our judicial institutions. The Court of Appeal of Lyon shall refuse to deliver a first-class political militant with refugee status, to a a State that comes further and further under the spotlight for its violations of human rights and has little regard for its international engagements.
In addition, Maîtres Jean-Pierre Mignard and Gérard Tcholakian, Lawyers at the Bar of Paris and et Maitre Bruno Rebstock, lawyer at the bar of Aix-en-Provence, legal counsels for Mr. Mukhtar Ablyazov have today summoned Ms. Christiane Taubira, Garde des Sceaux/ Minister for Justice, to file a claim in order to pursue an investigation by the Judicial services inspectorate concerning possible and serious malfunctions in the administration of justice and in particular, concerning the behavious by the magistrates and the Prosecutor, in the affair of Mr. Mukhtar Ablyazov, for whom extradition was requested by Russia and Ukraine. Certain facts, should they be confirmed, will show serious and repeated violations of the right to defence of Mr. Ablyazov, opponent to the Kazakh ruling regime.
In any case, the defence team of Mr. Ablyazov insists that a light be shone as soon as possible on the publications by the website, http://trust.ua and determine whether these are false or true.
The result is an uneasiness that surrounds the opinion of the Chamber of Instruction of the Court of Appeal of Aix-en-Provence, which must now be dispelled by the Ministry of Justice or by the appropriate authority.
