WHEREAS this Court has been requested in writing, submitted today to the Registry of this Court Division by Mr. Alexandr Pavlov’s litigation counsel, to suspend the contested decision of denial of political asylum on an early preliminary injunction measure basis,

WHEREAS said request cannot be tabled on the basis of article 135 of Spanish Jurisdiction Act, as said procedural Act does not provide a possibility to modify a preliminary injunction measure, WHEREAS said request clearly consists, however, of a modification of an order issued on 30 October 2013 by this Court Division (denial of suspensory measure by ordinary proceeding), WHEREAS said writing shall be transferred to the Spanish State Legal Service, which shall have three (3) days to make relevant allegations in respect hereto,

WHEREAS Court Secretary has reported that the Spanish Council of Ministers, by its approval decision as of 14 February 2014, has approved the execution of the order issued by the Criminal Division of Spanish National High Court to extradite the Plaintiff,

NOW, THEREFORE, this Court rules that the Defendant shall not perform any action that would result in Plaintiff’s departure from the territory of Spain, until a relevant Court Division has ordered accordingly in relation to the requested injunction procedure.

This Order shall be transmitted to the Section Two of the Criminal Division of this National High Court for further proceedings.
