Mark Feygin on the case of Mukhtar Ablyazov

Attorney-at-law Mark Feygin confirmed in an interview for the A24 TV channel, that the investigative authorities of the Russian Federation had unlawfully prevented him from being admitted to act on the criminal case of Mukhtar Ablyazov, opened by the Ministry of Internal Affairs. Feygin asserts that he had provided the Ministry’s investigation department with the relevant documents, including the original Power of Attorney signed by Ablyazov. However, his application to represent the client was denied.

“In accordance with the penal code of procedure, the volunteering of a new lawyer for the defence does not depend on the investigative authorities and an officer of the Ministry of Internal Affairs has no right to decide as to whether to admit a defence lawyer to the case or not, and which lawyer may participate in the case and which may not,” emphasised Feygin in an interview.

The lawyer intends to appeal against the decision based on the provisions of the penal code of procedure and believes that the investigators fear his involvement in the case.
“I know that there have been instances of barring lawyers before from this case and in such situations the investigators did not encounter objections. But now, this violation of the law will, first, be discussed in public and, second, the court authorities in France which deal with the matter of extradition will be informed. I don’t think the Russian investigators could cut any ice there. I understand what they are getting at: protraction. The sooner I start working on the case (which will happen, sooner or later), the sooner, through pleadings and motions, I can appeal against their actions for the past three years, “explained the lawyer.

In the meantime, Mark Feygin can meet Mukhtar Ablyazov unobstructed, in France, where it does not cross anybody’s mind to prohibit contact with the defence lawyer.
